Inherited Property and Estate Sales in Georgia and Alabama
Short answer: Being named in a will, or being an heir, doesn't by itself give you authority to sign a sale. Someone first has to be confirmed as the person who can act for the estate, usually through the county probate court. While that happens, protect the property, gather its records, and get the heirs on the same page.

First 30 days checklist
- Secure the house and change the locks.
- Call the insurer about vacancy coverage.
- Keep the utilities on and forward the mail.
- Photograph the contents.
- Find the deed, mortgage, property tax and HOA records.
- Don't remove or sell contents until the personal representative approves.
Who can sign (confirm with a probate attorney)
Georgia: the county probate court issues letters to the executor or administrator (the personal representative). Unless the will gives a power of sale, the personal representative generally must petition the court for leave to sell estate real property (O.C.G.A. § 53-8-13). Property in a funded trust is sold by the trustee.
Alabama: the county probate court (Madison County Probate Court for Huntsville and Madison) issues letters testamentary or of administration. Unless the will expressly authorizes the sale, the personal representative generally needs prior court approval to sell estate real estate (Ala. Code § 43-2-844).
